Fireworks in Orange

On November 5, 2024, Orange voters approved Measure AA with 61.18% of the vote. By approving Measure AA, Orange voters authorized the sale, possession, and discharge of Safe and Sane Fireworks in the City of Orange subject to reasonable rules and regulations of the City Council.

To implement this program, the City Council adopted rules, regulations, and processes to carry out the Safe and Sane Fireworks program.

Provided on this page are highlights of the program and information on 1) how to sell Safe and Sane Fireworks and 2) frequently asked questions about fireworks as well as buying and using Safe and Sane Fireworks.

All non-Safe and Sane fireworks, including Safe and Sane Fireworks that have been altered, are illegal in the City of Orange.

Possessing, using, allowing for (e.g., property owner who rents their property to tenants), facilitating, or failing to prevent the use of ILLEGAL fireworks can result in significant fines exceeding $1,000 per violation.

How to Sell Safe and Sane Fireworks

Phase I: Applications

To ensure equal opportunity, the City of Orange established a lottery process to sell Safe and Sane Fireworks. All Qualified Organizations, as defined in Orange Municipal Code Chapter 8.13 and Resolution No. 11648, may apply to be included in the lottery.

Phase II: Lottery Process and Permit Phase

Applicants selected in a random drawing at a City Council meeting will move on to the permit phase. They will work with their selected Safe and Sane Fireworks Wholesaler and the Orange Fire Department to secure all necessary approvals to receive a permit for a two-year period.

Those receiving a permit will be prohibited from participating in the immediate application and lottery process after the two-year permit cycle has completed.

When and Where can I buy and use Safe and Sane Fireworks?

Safe and Sane Fireworks may be sold or bought on the following days:

July 1st - July 3rd from 12:00 p.m. to 10:00 p.m.
July 4th from 10:00 a.m. to 9:00 p.m.

Safe and Sane Fireworks may only be used on July 4^th between Noon and 10:00 p.m.

Where are Safe and Sane Fireworks not allowed?

Safe and Sane Fireworks may not be discharged in the areas highlighted on the following map:

In addition, there are several categories that detail where Safe and Sane Fireworks may or may not be allowed, and as a reminder, any and all other fireworks, including altered Safe and Sane Fireworks are illegal:

Safe and Sane Fireworks cannot be used on any public property, including public streets, highways, sidewalks, alleys, parks or other publicly owned property, buildings or facilities except for residential sidewalks, alleys, and streets.
Safe and Sane Fireworks cannot be used on any property within a commercial district, except for residential uses within the commercial district.
Safe and Sane Fireworks cannot be used on any property within an industrial district/manufacturing district except for residential uses within both districts.
Safe and Sane Fireworks cannot be discharged upon or over or onto the property of another without their consent.
Safe and Sane Fireworks cannot be discharged within 10 feet of any residence, dwelling, or other structure.
Safe and Sane Fireworks cannot be used within 300 feet of a fireworks stand.
Safe and Sane Fireworks cannot be used within 100 feet where gasoline or any other flammable liquid is stored or dispensed.

What is the penalty for igniting Safe and Sane Fireworks outside of the designated time or possessing illegal, altered or non-Safe and Sane Fireworks?

Depending on the type of citation, fines exceeding $1,000 may be imposed.

Misdemeanor citations:

Fines up to $1,000 may be imposed.

Administrative citations:

Each discharge, use, and/or possession:

1st Offense: $2,000
2nd Offense: $4,000
3rd and Subsequent Offenses: $6,000

Any host, spectator, and/or property owner allowing and/or observing illegal firework discharge:

1st Offense: $2,000
2nd Offense: $4,000
3rd and Subsequent Offenses: $6,000
