Hazardous Materials Disclosure Process

Dear Business Owner/Operator:

The Orange City Fire Department is the administering agency for the Hazardous Materials Business Emergency Plan (HMBEP) requirement of the California Health and Safety Code (Chapter 6.95). All businesses operating within the City of Orange must disclose their hazardous materials on the downloadable forms provided under the disclosure forms section.

Reporting Requirements
If your facility uses, handles, or stores materials at any one time, in quantities greater than or equal to:

  1. 55 gallons of a liquid
  2. 500 pounds of a solid
  3. 200 cubic feet of a gas
  4. The threshold planning quantity for extremely hazardous substances, under both of the following conditions:  a) The hazardous material is an extremely hazardous substance, as defined in Section 355.61 of Title 40 of the Code of Federal Regulations
     b) The threshold planning quantity for that extremely hazardous substance listed in Appendices A and B of Part 355 of Title 40 of the Code of Federal Regulations is less than 500 pounds.
  5. Radioactive materials above the reportable threshold
  6. Carcinogens

Exceptions

  1. 5,000 pounds or less of a solid or liquid substance that is classified as a hazard for purposes of Section 5194 of Title 8 of the California Code of Regulations solely as an irritant or sensitizer.
  2. 1,000 cubic feet or less of a gas at standard temperature and pressure and is classified as a hazard for the purposes of Section 5194 of Title 8 of the California Code of Regulations solely as a compressed gas. This does not include gases in a cryogenic state.
  3. Oxygen, nitrogen, and nitrous oxide, ordinarily maintained by a physician, dentist, podiatrist, veterinarian, or pharmacist, at his or her office or place of business, stored at each office or place of business in quantities of not more than 1,000 cubic feet of each material at any one time.
  4. Lubricating oil for a single business facility, if the total volume of each type of lubricating oil handled at that facility does not exceed 55 gallons and the total volume of all types of lubricating oil handled at that facility does not exceed 275 gallons at any one time.
  5. Oil-filled electrical equipment that is not contiguous to an electric facility is exempt from this section and Sections 25505 and 25509 if the aggregate capacity is less than 1,320 gallons.

Program Changes
Changes to any portion of the HMBEP require notification to the Orange City Fire Department Hazardous Material Section within 15 days. If the facility no longer meets reporting requirements, notification shall be made within 30 days to avoid assessed penalties.

Spill Notification
Should a release or potential release occur, the California Health and Safety Code requires handlers of hazardous materials to immediately notify the following:

Public Records
Information contained in these disclosures (except for plot plans, trade secrets and sensitive information) is public record and may be reviewed during normal fire department business hours (M-Th, 7am-5:30pm) with prior appointment.
